ESQUIRES has successfully defended the interests of INVESTMENT CAPITAL UKRAINE LLC 150 150 Esquires

ESQUIRES has successfully defended the interests of INVESTMENT CAPITAL UKRAINE LLC, a member of the ICU group, which appealed as a plaintiff in a dispute with P. Kostenko (who is a people’s deputy) about the denial of inaccurate information about the professional activities of INVESTMENT CAPITAL UKRAINE LLC.

The Kyiv Court of Appeal upheld the decision of the court of first instance and obligated P. Kostenko to deny the false information that he had spread before. The decision entered into force on 08.02.2017.

So, in accordance with the court’s decision, the defendant is obliged to refute inaccurate information about the participation of INVESTMENT CAPITAL UKRAINE LLC (part of the ICU group) in the “withdrawal of profits from state financial institutions” and the payment of “corruption services” (orders) by the Plaintiff.”

The plaintiff, with the participation of ESQUIRES, applied to the court for protection after publication by the P. Kostenko of a copy of the deputy’s appeal to a number of state bodies that contained false information, namely, examples of “speculative operations with domestic government loan bonds” supposedly conducted by the company and led to significant “speculative income” of Bidders. However, LLC “INVESTMENT CAPITAL UKRAINE” did not participate in any of the transactions with government bonds, as indicated by P. Kostenko.

In his appeal, P. Kostenko noted that the reason for the spread of false information about LLC INVESTMENT CAPITAL UKRAINE was his conflict with the National Bank of Ukraine.

ESQUIRES lawyers have proven in court that P. Kostenko spread inaccurate information. which caused damage to the plaintiff’s reputation. The defendant, by a court decision, is obliged to deny false information in the same way that it was spread – on the portal  eizvestia.com and his [P. Kostenko] personal Facebook page.

The interests of the Client in the courts of first instance and appeal were represented by partner Artem Saprykin.
