\u00a0<\/span>At the beginning of the war unleashed by Russia against Ukraine, President of Ukraine Volodymyr Zelensky announced a general mobilization to fight the enemy. At the same time, <\/span><\/i>the <\/span><\/i>recruitment<\/span><\/i> into the ranks of the Armed Forces of Ukraine has its own rules and, in particular, provides for a delay for certain categories of those liable for military service, including those who work for critical infrastructure. What are the rules for deferment for such categories of workers and what is the reservation of those liable for military service, said Victoria Kovalchuk, partner of the ESQUIRES law firm.<\/span><\/i><\/p>\n

What is a military service <\/span><\/b>reservation?<\/span><\/b>\u00a0<\/span><\/p>\n

\u00a0<\/span>Under martial law, there is a procedure for <\/span>reservation of <\/span>persons liable for military service for enterprises that meet the needs of the Armed Forces, other military <\/span>groups<\/span>, as well as the population. Reservation means the actual <\/span>granting<\/span> of a deferment to employees from recruitment in connection with mobilization.<\/span>\u00a0<\/span><\/p>\n

Reservation is possible in all areas of activity, sectors of the economy, in particular for banks that perform operations in\u00a0 condition of a special period.<\/span>\u00a0<\/span><\/p>\n

Some ministries described the procedure in detail (agro, transport), others need to be contacted for clarification.<\/span>\u00a0<\/span><\/p>\n

The <\/span>decision<\/span> on<\/span> <\/span>reservat<\/span><\/span>i<\/span><\/span>on<\/span><\/span> is<\/span> <\/span>issued<\/span><\/span> by<\/span> the<\/span> order<\/span> of<\/span> the<\/span> Ministry<\/span> of<\/span> Economy<\/span>, <\/span>an<\/span> extract<\/span> from<\/span> this<\/span> order<\/span> is<\/span> sent<\/span> to<\/span> the<\/span> company<\/span> that<\/span> submitted<\/span> the<\/span> proposals<\/span>. The <\/span>decision<\/span> specifies<\/span> the<\/span> duration<\/span> of<\/span> the<\/span> delay<\/span>, <\/span>which<\/span> may<\/span> exceed<\/span> six<\/span> months<\/span>.<\/span><\/span>\u00a0<\/span><\/p>\n

When is the deferral f<\/span><\/b>rom<\/span><\/b> recrutment cancelled?<\/span><\/b>\u00a0<\/span><\/p>\n

\u00a0<\/span>A deferment from recrutmen<\/span>t<\/span> is subject to cancellation in the event of:<\/span>\u00a0<\/span><\/p>\n

  1. Expiration of its validity.<\/span><\/li>\n
  2. Co<\/span>nclusion<\/span> of the fulfillment or cancellation of the task for the enterprise to meet the needs of the Armed Forces, other military formations, and the population.<\/span><\/li>\n
  3. Liquidation of the company.<\/span><\/li>\n
  4. Dismissal of a person liable for military service.<\/span><\/li>\n<\/ol>\n

    Which is the reservation procedure?<\/span><\/b>\u00a0<\/span><\/p>\n

    The Ministry of Agrarian Policy provided information to enterprises of the agr<\/span>arian<\/span> industry <\/span>with <\/span>explanations, in order t<\/span>o <\/span>conduct a set of spring-summer field work<\/span> in due time<\/span>, ensure the production of agricultural products and food to meet the needs of the Armed Forces of Ukraine, other military <\/span>group<\/span>s and the population, enterprises have the right to send<\/span> the<\/span> proposals for <\/span>reservations<\/span>.<\/span>\u00a0<\/span><\/p>\n
