The <\/span>migration<\/span> of<\/span> Ukrainians<\/span> (<\/span>mostly<\/span> women<\/span> and <\/span>children<\/span>) <\/span>to<\/span> EU <\/span>countries<\/span> helps<\/span> to<\/span> ensure<\/span> the<\/span> \u0441alm<\/span> of<\/span> the<\/span> defenders<\/span> of<\/span> the<\/span> homeland<\/span> for<\/span> their<\/span> relatives<\/span>. <\/span>Due<\/span> to<\/span> numerous<\/span> questions<\/span> of<\/span> clients<\/span> it<\/span> is<\/span> considered<\/span> appropriate<\/span> to<\/span> cover<\/span> the<\/span> following<\/span> questions<\/span>.<\/span><\/span>\u00a0<\/span><\/p>\n

Disorientation<\/span><\/b>\u00a0<\/span><\/p>\n

Most of the available advice and manuals for migrants are based on the well-established practice of granting refugee status (1951 Geneva Convention relating to the Status of Refugees) or other types of \u201clegalization\u201d. <\/span>Due to<\/span> these explanations, we can conclude that the migration processes in the EU countries are too complicated, lengthy, sometimes unpredictable and expensive (if you use the services of lawyers). Fortunately, all these procedures are not relevant to the needs of Ukrainians in these turbulent times, so we advise you not to use the recommendations posted online before 0<\/span>4.<\/span>0<\/span>3.<\/span>2022.<\/span><\/p>\n

Unchanged positions<\/span><\/b>\u00a0<\/span><\/p>\n

As before, Ukrainians do not need visas to enter and stay in the Schengen area for 90 days in any 180-day period.<\/span>\u00a0<\/span><\/p>\n

Implemented changes<\/span><\/b>\u00a0<\/span><\/p>\n

Back in 2001, <\/span>Regulation<\/span> No. 2001\/55 \/ EC of 20.07.2001 on temporary protection was approved (on the minimum standards for granting temporary protection in the event of a massive influx of displaced p<\/span>opulations<\/span>, measures contribut<\/span>ing<\/span> to balancing the efforts of Member States to accept such persons and further consequences), which has never been applied before.<\/span>\u00a0<\/span><\/p>\n

The decision of the EU Council No. 2022\/382 <\/span>as <\/span>of 03\/04\/2022 recognized the presence of a massive influx of displaced p<\/span>opulation<\/span> from Ukraine and introduced their temporary protection.<\/span>\u00a0<\/span><\/p>\n

Temporary protection<\/span><\/b>\u00a0<\/span><\/p>\n

Temporary protection is a type of international protection that must be distinguished from refugee status.<\/span><\/p>\n

The <\/span>institute<\/span> of<\/span> temporary<\/span> protection<\/span> is<\/span> new<\/span>. <\/span>Its<\/span> disadvantage<\/span> is<\/span> its<\/span> temporary<\/span> nature<\/span>: <\/span>it<\/span> was<\/span> introduced<\/span> for<\/span> a <\/span>year<\/span> with<\/span> the<\/span> possibility<\/span> of<\/span> extension<\/span> twice<\/span> for<\/span> 6 <\/span>months<\/span> and <\/span>by<\/span> a <\/span>separate<\/span> decision<\/span> for<\/span> <\/span>one more<\/span><\/span> year<\/span> (<\/span>up<\/span> to<\/span> 3 <\/span>years<\/span> on<\/span> average<\/span>), and <\/span>can<\/span> also<\/span> be<\/span> terminated<\/span> ahead<\/span> of<\/span> schedule<\/span>.
