The VII International Criminal Law Forum, which was recently held in Kyiv with the support of ESQUIRES, became an important platform for discussing a number of topical issues in the field of criminal law.

  1. The Forum participants identified several key areas that require attention:
    Plea bargaining:
    The legislative changes that entered into force on 1 November have improved the mechanism for concluding plea bargaining agreements, but there is a risk of abuse of this tool, particularly in terms of prejudice and economic impact.
  2. Confiscation of assets:
    – Asset confiscation has become an important tool in the fight against corruption. It is important to ensure that such sanctions have a real economic impact.
    – Plea bargaining can facilitate a more rapid recovery of losses for the state through confiscation.
  3. Reform the judicial system:
    – Local courts face problems with delays in considering corruption cases, which affects the efficiency of the judiciary.
    – The High Anti-Corruption Court has shown a higher level of efficiency, issuing decisions promptly and reducing the time taken to consider cases.
  4. The need for further reforms:
    – Continued improvement of judicial practice and legislation on plea bargaining is important for the achievement of justice.
    – It is necessary to ensure proper monitoring of the implementation of plea bargaining agreements in order to avoid their use as a mechanism of pressure or manipulation in judicial practice.
