With ESQUIRES as a partner, the anniversary 10th Business & Legal Energy Forum, organised by Legal Practice Publishing, brought together leading experts to debate the sector’s key challenges and development pathways in today’s environment.


Session II, which focused on generation as the basis for recovery in the energy system, was moderated by Oleksandr Shkelebei, ESQUIRES’s Managing Partner. The discussion covered legislative initiatives, the respective roles of state-owned and private companies, and practical steps to ensure the energy sector operates stably.

During Session III, Vitalii Izviekov, Counsel at ESQUIRES, spoke about recent case law concerning the deprivation and restriction of the right to use subsoil (mineral resources). In particular, he highlighted the Supreme Court’s key positions on:
– the possibility of terminating/suspending a special subsoil use permit due to sanctions imposed on an ultimate beneficial owner;
– the impact of a subsoil user’s active remediation efforts on decisions to terminate such permits;
– the specifics of allocating land plots for subsoil use; and
– selected issues of interim relief in cases challenging orders of the State Service of Geology and Subsoil of Ukraine.
